I AM AWARE AND UNDERSTAND THAT THE PRODUCT IS A POTENTIALLY DANGEROUS PRODUCT WHICH HAS NOT BEEN APPROVED FOR USE BY THE FOOD AND DRUG ADMINISTRATION (FDA) OR ANY OTHER AGENCY, NOR HAS IT BEEN APPROVED NOR IS IT INTENDED FOR ANY MEDICAL PURPOSES OR TREATMENTS.  I UNDERSTAND THAT I MUST CONSULT A MEDICAL PROFESSIONAL PRIOR TO THE USE OF THIS PRODUCT; THE COMPANY SHALL NOT BE HELD LIABLE FOR MY FAILURE TO DO SO.  I AM AWARE THE USE OF THIS PRODUCT INVOLVES THE RISK OF PERSONAL INJURY.  

NOTWITHSTANDING THE RISK, I ACKNOWLEDGE THAT I AM KNOWINGLY AND VOLUNTARILY PURCHASING THE PRODUCT WITH AN EXPRESS UNDERSTANDING OF THE POTENTIAL RISK INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, AND/OR DEATH, ARISING FROM THE PRODUCT.

The Company does not intend to provide any advice or representations that are medical in nature.  The Company is not a medical provider, physician, or other healthcare professional. 

WARNINGS

  • ALWAYS CONSULT WITH YOUR DOCTOR OR OTHER HEALTHCARE PROFESSIONAL BEFORE USING THE PRODUCT.
  • Immediately discontinue use of the Product if you experience pain while inserting the Product and seek immediate medical attention.
  • Do not use the Product if pregnant. Consult with your doctor or healthcare professional prior to beginning use of the Product after pregnancy.
  • Do not use at the same time as other intra-vaginal devices. Do not use during intercourse.
  • Do not use if you are experiencing any urinary or vaginal infection.
  • The Product is intended for internal vaginal use only. Do not insert the Product in any other bodily cavity or opening. 
  • KEEP OUT OF REACH OF CHILDREN. The Product may present a choking hazard if put in mouth.
  • Our Product must be used in accordance with manufacturer-specified instructions. The Company is not responsible for any damages arising from use in any other manner.
  • In no event will the Company’s liability exceed the purchase price of the Product, regardless of event or cause of action. Under no circumstance will the Company be liable for any direct, indirect, special, punitive, or other damages.

Waiver of Liability

By using this Product, I acknowledge that I am accepting any and all risks associated with its use.  The Company is not responsible for any injury or damage related to the use of this Product. I agree to indemnify and hold the Company harmless from any claims, damages, losses, liability, or costs arising out of the use of the Product.

Except for any warranty claims, I hereby expressly waive and release any and all claims, now known or hereafter known, against the Company, and its officers, directors, manager(s), employees, agents, affiliates, shareholders, successors, and assigns (collectively, "Releasees"), which are caused by, arise out of or attributable to the Product. I covenant not to make or bring any such claim against the Company or any other Releasee, and forever release and discharge the Company and all other Releasees from liability under such claims. This waiver and release does not extend to claims for gross negligence, willful misconduct, or any other liabilities that the law in my state of residence does not permit to be released by agreement.

I shall defend, indemnify, and hold harmless the Company and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including  attorney fees, fees, the costs of enforcing any right to indemnification under this Release, and the cost of pursuing any insurance providers, arising out or resulting from any claim of a third party related to the Product. If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable such term or provision in any other jurisdiction. This Release is binding on and shall inure to the benefit of the Company and me and our respective heirs, successors, and assigns. All matters arising out of or relating to this Release shall be governed by and construed in accordance with the internal laws of the State of Colorado without giving effect to any choice or conflict of law provision or rule (whether of the State of Colorado or any other jurisdiction). Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in the City and County of Denver, Colorado and I hereby consent to the exclusive jurisdiction of such courts.
